L’objet de cette étude est d’analyser un conflit constitutionnel, celui qui se manifeste par la « question catalane ». En 2017, la tentative de sécession a pu donner l’impression d’un conflit portant sur l’indépendance de la Catalogne. Mais si l’on affine les visions des différents acteurs intéressés et des multiples enjeux qui sous-tendent le conflit, l’on s’aperçoit que celui-ci porte sur la forme de l’unité de l’Espagne. L’ambition historique de la Catalogne depuis la suppression de ses institutions en 1714 n’a jamais été l’indépendance. Elle a toujours été le fédéralisme. Si la Catalogne a un temps pu croire que cette ambition avait été assouvie par la Constitution espagnole (CE) de 1978, c’est parce que celle-ci reposait sur un compromis dilatoire. À la question de savoir si l’Espagne était un État-nation décentralisé ou une Fédération plurinationale, la CE n’avait pas tranché. C’est le Tribunal constitutionnel espagnol, dans sa Sentence 31/2010 sur le Statut catalan de 2006, qui a pris le risque de mettre un terme à cette ambivalence constitutive. En jugeant qu’il y a qu’une seule nation en Espagne et que le Statut n’est pas un pacte constitutionnel, il a ouvert la voie à une revendication jusqu’alors marginale : celle du droit de décider. Si ce dernier n’a pour l’heure pas d’existence juridique, la CE n’interdit pas pour autant l’organisation d’un référendum consultatif sur l’indépendance, mais l’État espagnol refuse de l’autoriser. Tels sont les contours du conflit qui ont conduit à une crise sans précédent. Par l'analyse constitutionnelle des causes de la crise, nous pourrons apporter un nouveau regard sur les solutions qui pourraient être apportées à la question de « l’emboitement » de la Catalogne dans l’Espagne.
This study analyses the Catalan constitutional conflict. In 2017, the catalan attempt of unilateral secession could give the impression of a fundamental conflict about independence. However, if one refines its views on the different actors implicated and on the multiple stakes, we understand that this conflict is more about the form of the Spanish political and constitutional unity. Since the abrogation of of its institutions in 1714, the Catalan historical ambition was never the separation from Spain. The ambition has always been the settlement of federalism. If for some time Catalonia could believe that this ambition had been served by the 1978 constitution, it was because this constitution was founded on a dilatory formal compromise. To the question : is Spain a decentralized nation state or a pluri national federation ? The 1978 constitution had not answered. In 2010, the constitutional court put an end to this constituent ambivalence with the 31/2010 judgment on the 2006 Catalan status. By explicitly judging that there is only one nation in Spain and that the status of autonomy is not a near constitutional pact, but a true organic law, it opened up the way to a Catalan claim for the right to decide. If this right holds no juridical power today, the constitution does not forbid the hold of a referendum on independence. However, the Spanish government will not allow it. This conflict born from the 31/2010 judgment led to an unprecedented constitutional crisis. Analyzing the political and constitutional deep causes of this crisis, we can understand the true meaning of this catalan quest and bring a fresh look on the constitutional solutions for the status of Catalonia in Spain.
