Mes recherches se sont concentrées sur l’observation des expériences concrètes d'interprétation et d’application des dispositions constitutionnelles qui, au fil du temps, ont conduit au delà de la formulation littérale de la Charte constitutionnelle, notamment dans les systèmes juridiques italien et français. Partie I de l’étude est consacrée à la dialectique entre dimension normative et dimension descriptive, en tant qu’élément particulier du droit constitutionnel. En fait, nous observons que le droit constitutionnel se compose, ainsi que des règles découlant des dispositions constitutionnelles, également des éléments d’origines différentes, que nous appelons exogènes, destinés à interagir avec la dimension formelle dans le cadre d’une intégration mutuelle. On essaye de souligner comment l’objectif d’une exact actio finium regundorum du droit constitutionnel devrait partir du principe selon lequel ce domaine du droit se développe comme “droit écrit” et, en même temps, comme “droit non écrite”. Partie II de l’étude est consacrée à la notion de mutation constitutionnelle informelle, et au débat doctrinal sur ce thème. La deuxième partie de la thèse contient aussi un aperçu des événements emblématiques de l’ordre constitutionnel italien et français, à la suite desquels il peut être enregistrée un changement du cadre constitutionnel, au vu des résultats à chaque fois obtenus par l’interprétation des dispositions constitutionnelles. Dans la Partie III, nous concluons au sens de la dimension physiologique de la phénoménologie en question, en tant qu’inhérent à la nature même des constitutions modernes, lesquelles sont à entendre, plutôt qu’au sens purement statique, en tant que processus.
My research has focused on the observation of the concrete experience of interpretation and application of constitutional provisions that, over time, have led beyond their literal tenor, with particular reference to italian and french legal systems. Part I is devoted to the dialectic between prescriptive and descriptive dimensions, as distinctive character of constitutional law. We observe that constitutional law, besides the rules arising from the written provisions, is composed of further elements, that we define exogenous, destined to interact with formal dimension in the framework of a mutual integration. The considerations developed in Part I lead us to conclude that the aim of a precise actio finium regundorum of constitutional law should be based on the assumption for which such field of law evolves both as written law and as unwritten law. Part II concerns the concept of infomal constitutional change, the doctrinal debate, and the modalities of the informal changes into speech. Therefore, we sum up some emblematic events of italian and french legal systems, following which it is possible to report a change of the constitutional framework in light of the outcomes of the interpretation carried out. In Part III, we conclude observing the physiological dimension of the category into speech, as inherent to modern constitutions, which must be approached, rather than in a static sense, as a process.
